GENERAL TERMS AND CONDITIONS (GTC)

1.Introduction
These General Terms and Conditions (hereinafter referred to as: GTC) govern the services operated by Magic Empire Kft. (hereinafter referred to as: Service Provider). www.themagic.hu the terms and conditions for using the website, using the services available online, and purchasing gift vouchers online.

The purpose of these GTC is to define in detail the rights and obligations of the Service Provider and the natural or legal person using the website (hereinafter referred to as: User or Customer).

By using the website or placing an online order, the User declares that he has read, understood and accepts the provisions of these GTC as binding on him.

If the User does not agree with any provision of these GTC, he/she is not entitled to use the website's services.

These GTC are published in electronic form on www.themagic.hu website, where it is constantly available and downloadable.

   Hereinafter, the above business company will be referred to as the Service Provider.
3. Scope of the GTC

These GTC cover:

• a www.themagic.hu to use the website;
• for online gift voucher purchases;
• to contact you via the website;
• to use the newsletter service;
• information related to online table reservations;
• for all electronic transactions that take place through the website.

The table reservation service is provided by the Service Provider through the online reservation system of an external partner, Reservours. During the online reservation, Reservours' own contractual and data processing terms and conditions also apply.

These GTC apply exclusively to the legal relationship between the Service Provider and the User and do not apply to services provided by third parties.

4. Relevant legislation
   
   These GTC are governed in particular by the provisions of the following laws:
   
   Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR)
   Act V of 2013 on the Civil Code
   Act CVIII of 2001 on Electronic Commerce Services
   Act CLV of 1997 on Consumer Protection
   Government Decree 45/2014. (II.26.) on the detailed rules of contracts between consumers and businesses
   Act XLVIII of 2008 on Economic Advertising Activities
   Act C of 2000 on Accounting
   Act CXXVII of 2007 on Value Added Tax;
   as well as all other applicable Hungarian and European Union legislation.
5. Definitions
   
   For the purposes of these GTC:
   
   Service provider:
   A business entity as defined in Section 2 of these GTC.
   
   User:
   Any natural or legal person who visits or uses the website.
   
   Buyer:
   The User who purchases a gift certificate through the website.
   
   Consumer:
   A natural person acting under the Civil Code who is acting outside his/her economic or professional activity.
   
   Website:
   A www.themagic.hu website and all its subpages.
   
   Gift voucher:
   A voucher representing a payment entitlement of a specified value, redeemable at a later date, sold electronically by the Service Provider.
   
   Electronic contract:
   A contract that the parties conclude electronically.
   
   Contract concluded between distant parties:
   A contract that is concluded without the simultaneous physical presence of the parties, exclusively using a means of telecommunication.
6. Using the website
   
   A www.themagic.hu The purpose of this website is to provide visitors with information about The Magic II restaurant's services, food and beverage offerings, and events, as well as the opportunity to purchase a gift certificate, contact us, subscribe to our newsletter, and make a table reservation.
   
   Using the website does not require registration.
   The User is obliged to use the website for its intended purpose and in accordance with applicable laws.
   
   When using the website, it is particularly prohibited to:

• use for illegal or unfair purposes;
• hindering the operation of the website;
• automated data collection or copying without the prior written permission of the Service Provider;
• activity aimed at circumventing the website's security system;
• uploading viruses, malware or other harmful code;
• unauthorized use of the content on the website.

The Service Provider reserves the right to modify the operation of the website at any time, temporarily suspend it for maintenance or improve it.

The Service Provider is not liable for any damages resulting from the temporary unavailability of the service, if it is related to normal operation, maintenance or an unforeseen technical error.

7. Creation of the online contract
   
   Gift vouchers that can be purchased through the website are ordered electronically.
   
   By placing the order, the Customer makes an offer to purchase the gift certificate.
   
   The contract is concluded when the Service Provider confirms the order electronically.
   
   The automatic system message sent about the order only confirms receipt of the order and does not in itself result in the conclusion of a contract.
   
   The language of the contract is Hungarian.
   
   The concluded contract is considered an electronically concluded contract, which the Service Provider does not file separately, but retains for the period prescribed by the relevant legislation.
8. Purchase a gift certificate
   
   It is possible to purchase an electronic gift certificate on the website.
   
   The gift certificate is valid for use at The Magic II restaurant up to the value indicated on it.
   
   The Buyer is obliged to provide accurate data when placing an order.
   
   The Service Provider is not liable for any damages resulting from incorrect or incomplete data provided during the order.
   
   The Service Provider reserves the right to refuse the order in justified cases, especially if:

• the data provided is obviously false;
• the payment is not made;
• there is suspicion of abuse;
• Due to a technical error, an incorrect price or incorrect content is displayed.

If an offer appears on the website that is obviously incorrect due to an incorrect price or other system error, the Service Provider is not obliged to fulfill the order at that price.

9. Payment methods
   
   The purchase of an online gift certificate is made exclusively by electronic payment.
   
   Payment by bank card is provided by the SimplePay online payment system.
   
   Bank card details are not sent to the Service Provider, they are handled exclusively by the SimplePay system.
   
   During the payment process, the Customer will be redirected to SimplePay's secure payment interface.
   
   In case of technical problems during payment, the Buyer can also contact the payment service provider's customer service directly.
   
   The Service Provider does not store bank card information.
10. Invoicing
    
    After successful payment, the Service Provider issues an electronic invoice.
    
    The electronic invoice is issued through the Számlázz.hu system.
    
    The Buyer is obliged to provide the billing information in accordance with reality.
    
    The Service Provider is not responsible for any damages resulting from incorrectly provided data.
    
    The electronic invoice will be sent electronically to the email address provided by the Customer.
11. Prices
    
    The prices shown on the website are in Hungarian forints (HUF).
    
    Prices include value added tax (VAT), unless otherwise stated on the given page.
    
    The Service Provider reserves the right to modify prices.
    
    The price change does not affect orders that have already been confirmed.
    
    In the event of an obviously incorrect price being indicated, the Service Provider has the right to cancel the order or negotiate the correct price with the Customer.
12. Right of withdrawal
    
    The consumer's right of withdrawal is governed by the provisions of Government Decree 45/2014. (II. 26.).
    
    The consumer has the right to withdraw from the contract within fourteen (14) days from the conclusion of the contract without giving any reason, except in cases for which the applicable legislation provides for an exception to the right of withdrawal.
    
    If the gift voucher is sent to the Customer electronically and the performance begins with the Customer's prior, express consent before the expiry of the fourteen (14) day withdrawal period, the Customer acknowledges that by starting the electronic performance, he may lose his right of withdrawal under the conditions specified in the applicable laws.
    
    The exercise of the right of withdrawal and its conditions are governed in all cases by the applicable Hungarian and European Union consumer protection laws.
13. Defective performance and warranty
    
    The Service Provider is obliged to provide services and products in accordance with applicable laws.
    
    In the event of defective performance, the consumer is entitled to warranty rights under the provisions of the Civil Code.
    
    The consumer may, at their option, request:

• the correction of the error;
• replacement of the service, if possible;
• appropriate price reduction;
• withdrawal from the contract if the conditions specified in the law exist.

The consumer is obliged to report the defect without undue delay after discovering it.

15. Complaints handling
    
    The Service Provider pays special attention to handling any complaints that arise quickly, professionally and in accordance with applicable laws.

    The Service Provider will investigate the complaints received and respond to them in writing within thirty (30) days at the latest.
    
    Complaint handling is free of charge.
    
    The Service Provider keeps records of received complaints and their handling in accordance with the relevant legislation.
16. Conciliation board procedure and enforcement
    
    If the consumer dispute cannot be resolved through negotiation between the parties, the consumer has the right to initiate proceedings before the conciliation body competent for his place of residence or stay.
    
    The procedures and jurisdiction of conciliation bodies are governed by the provisions of the applicable laws.
    
    The consumer is also entitled to go to court and use other legal remedies specified in the legislation.
17. Responsibility
    
    The Service Provider takes all reasonable measures to ensure that the information published on the website is accurate, up-to-date and true.
    
    The information on the website is for informational purposes only. The Service Provider reserves the right to change the menu, drink selection, prices, promotions, opening hours, programs, events and other information without prior notice.
    
    The Service Provider is not liable for any temporary errors or outages in the operation of the website that occur due to reasons beyond its control, in particular due to internet network failure, force majeure, power outage, service provider failure or failure of third-party systems.
    
    The Service Provider is not liable for damages resulting from failures in the User's IT device, software or internet connection.
    
    The Service Provider is not responsible for the consequences resulting from incorrect data provided by the User.
    
    The Service Provider excludes liability for any damage resulting from the User using the website illegally, for purposes other than those intended, or in violation of the provisions of these GTC.
18. Intellectual property
    
    A www.themagic2.hu All content on the website - in particular texts, images, graphics, logos, videos, animations, design elements, icons, audio materials, software and other copyrighted works - are the intellectual property of the Service Provider or a third party used with the permission of the right holder.
    
    Any content of the website may only be copied, reproduced, modified, distributed, publicly published or used in any other way with the prior written consent of the Service Provider.
    
    Unauthorized use of trademarks, logos, and branding on the website is prohibited.
    
    These GTC do not grant any rights of use regarding copyrighted content on the website.
19. Data protection
    
    The Service Provider processes personal data in accordance with the provisions of the applicable Hungarian and European Union data protection legislation, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), as well as the legislation on the right to informational self-determination and freedom of information.
    
    Detailed rules regarding the processing of personal data are contained in the Data Processing Notice published on the website.
    
    Detailed provisions regarding the use of cookies are contained in the Cookie Notice published on the website.
    
    Acceptance of these GTC does not replace familiarization with the Data Protection Notice and the Cookie Notice.
20. Force majeure
    
    The Service Provider is not responsible for delays or obstacles to performance that occur due to unavoidable external causes (force majeure).
    
    Force majeure is considered to be, in particular:

• natural disaster;
• flooding;
• fire;
• epidemic;
• war event;
• terrorist act;
• strike;
• official action;
• national or regional outage of internet or telecommunications services;
• electrical network failure;
• any event that is beyond the control of the Service Provider.

In the event of force majeure, the Service Provider is entitled to modify the date of performance to the necessary extent.

21. Modification of the GTC
    
    The Service Provider reserves the right to amend these General Terms and Conditions at any time.
    
    The amended GTC shall be effective from the date of publication on the website, unless the Service Provider specifies a different effective date.
    
    The amendments do not affect contracts concluded before the amendment entered into force.
    
    The User is obliged to familiarize himself with the General Terms and Conditions in force at all times before using the website.
22. Final provisions
    
    These General Terms and Conditions are governed by the provisions of Hungarian law.
    
    In matters not regulated in these GTC, Act V of 2013 on the Civil Code, Act CVIII of 2001 on electronic commerce services, consumer protection legislation, and directly applicable legislation of the European Union shall apply.
    
    If any provision of these GTC proves to be invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions.
    
    These General Terms and Conditions have been prepared in Hungarian and are continuously available in electronic form at www.themagic2.hu on the website.
